How can I sell or buy a property in Mallorca without travelling to the island?

Using a power of attorney in Mallorca

In these unusual times we are being asked regularly about signing for purchases or sales without being physically present in the notary.  In principle this is relatively easy if managed in advance.  The seller(s) or buyer(s) or both parties can provide a power of attorney in Mallorca (POA or poder in Spanish).

This is a document that allows another person to sign on their behalf if they cannot attend the notary here for whatever reason.  There is a specific set of instructions and requirements depending on each set of circumstances, but in principle you will need to go to a notary in your home country, sign a document that gives specific power to act in the sale or purchase to someone on the island, often a lawyer, one of our team or a friend who can act in your behalf.  This document then winds its way here via a service that your local notary will arrange (known as Hague agreement apostille or apostille de la Haya in spanish) and arrives to us by courier.

The person you have nominated can then attend the notary appointment on your behalf and under your specific instructions, agree to sell or buy as required.
